Classification under Swiss Law
๐ง BTCSilent is a purely technical service
BTCSilent is not a financial intermediary and is not subject to the Anti-Money Laundering Act (AMLA). The service exclusively performs a one-time, technical activation transaction โ without custody, without business relationship, without recurring payments.
1. Nature of Service
BTCSilent is a purely technical infrastructure service for activating BIP-352 Silent Payment addresses. The service:
- Does not custody private keys or funds
- Does not establish business relationships within the meaning of AMLA
- Does not offer financial services
- Is not subject to FINMA reporting
- Is not subject to the Financial Institutions Act (FinIA)
2. Why AMLA Does Not Apply
a) No Custody (Art. 2 Para. 1 lit. b AMLA)
BTCSilent never custodies assets or private keys. The service is fully non-custodial:
- Customers retain full control over their Bitcoin at all times
- The transaction occurs atomically via PayJoin (BIP-78)
- The customer technically pays directly to their own Silent Payment address
- BTCSilent never has access to customer funds
b) No Business Relationship (Art. 7 AMLA-FINMA)
No business relationship within the meaning of AMLA is established:
- Each Silent Payment address can only be activated once
- There are no recurring transactions
- No customer accounts are maintained
- There is no ongoing relationship between operator and user
- The service is one-time and complete after activation
c) Package Structure with Fixed Fees
Transaction amounts are transparent and include all fees:
- Mini: Send 0.001 BTC โ Receive 0.00086 BTC (14% fee incl.)
- Medium: Send 0.0025 BTC โ Receive 0.00225 BTC (10% fee incl.)
- Max: Send 0.01 BTC โ Receive 0.0092 BTC (8% fee incl.)
These amounts serve exclusively for technical activation. All network fees are already included.
d) No Financial Service
BTCSilent does not provide services within the meaning of FinIA or AMLA:
- No acceptance of public deposits
- No trading in financial instruments
- No asset management
- No payment service in the regulatory sense
- Merely technical execution of a Bitcoin transaction
3. Technical Mechanism (PayJoin/BIP-78)
Activation occurs via atomic PayJoin transaction:
- The customer initiates a Bitcoin transaction
- BTCSilent coordinates the PayJoin construction (BIP-78)
- The combined transaction is executed atomically
- Either complete activation occurs, or nothing happens
- There is no counterparty risk and no custody
Result: The customer's Silent Payment address receives its first on-chain transaction and is thus activated.
4. Distinction from Regulated Activities
BTCSilent is not comparable to:
- Crypto exchanges: We do not trade cryptocurrencies
- Wallet providers: We do not custody private keys
- Payment processors: We do not process payments for third parties
- Financial intermediaries: We do not establish business relationships
BTCSilent is comparable to technical infrastructure services such as:
- Bitcoin block explorers
- Bitcoin nodes as public infrastructure
- Open-source wallet software

BTCSilent offers no investment advice, financial advice, or tax advice. All information on this website serves exclusively to describe the technical service.
Users are responsible for:
- Compliance with local tax laws
- Understanding technical risks
- Evaluating suitability for their purposes

7. Disclaimer
Use of BTCSilent is at your own risk. The operator is not liable for:
- Technical errors or failures
- Losses due to incorrect address entries
- Bitcoin price fluctuations
- Changes in legislation
Bitcoin transactions are irreversible. Once sent, amounts cannot be reclaimed.
8. Applicable Law
Swiss law applies. Place of jurisdiction is Bern, Switzerland.
